    VỀ DẪN ĐỘ GIỮA CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM VÀ VƯƠNG QUỐC TÂY BAN NHA

     

    Cộng hòa xã hội chủ nghĩa Việt Nam và Vương quốc Tây Ban Nha (sau đây gọi là “các Bên”);

    Mong muốn duy trì và tăng cường hợp tác chung giữa hai nước;

    Mong muốn hợp tác có hiệu quả hơn giữa hai nước trong đấu tranh chống tội phạm và thi hành hình phạt, đặc biệt là đấu tranh chống tội phạm có tổ chức và khủng bố;

    Nhận thức được lợi ích của hai Bên trong việc tăng cường hợp tác trong lĩnh vực hình sự đặc biệt là về dẫn độ;

    Đã thỏa thuận như sau:

    Điều 1

     Nghĩa vụ dẫn độ

    Các Bên đồng ý dẫn độ cho nhau, phù hợp với các quy định trong Hiệp định này và theo yêu cầu của Bên kia, những người có mặt trên lãnh thổ của mình đang bị Bên kia truy nã để truy cứu trách nhiệm hình sự hoặc để thi hành hình phạt hoặc các biện pháp bảo đảm do Tòa án áp dụng, vì một tội có thể dẫn độ.

    Điều 2

    Các tội có thể bị dẫn độ

    1. Việc dẫn độ chỉ được thực hiện đối với những tội phạm có thể bị kết tội theo pháp luật cả hai Bên và thỏa mãn một trong các điều kiện sau:

    a) Nếu yêu cầu dẫn độ để tiến hành các thủ tục tố tụng thì tội phạm đó phải có hình phạt tù với thời hạn từ một năm trở lên theo quy định của pháp luật hai Bên; hoặc

    b) Nếu yêu cầu dẫn độ để tiếp tục thi hành hình phạt hoặc biện pháp bảo đảm liên quan đến tước tự do, thì tại thời điểm đưa ra yêu cầu dẫn độ, thời gian tiếp tục chấp hành hình phạt của người bị yêu cầu dẫn độ phải còn ít nhất là sáu tháng.

    2. Khi xác định một hành vi phạm tội cố cấu thành một tội phạm theo pháp luật của cả hai Bên như quy định tại khoản 1 Điều này, sẽ không tính đến việc hành vi đó có được đặt trong cùng một nhóm tội hoặc được gọi với cùng một tội danh hay không.

    3. Nếu yêu cầu dẫn độ liên quan đến hai hay nhiều hành vi, mà mỗi hành vi đó đều cấu thành một tội phạm theo quy định của pháp luật hai Bên và ít nhất một trong số các hành vi đó đáp ứng điều kiện về thời hạn phạt tù quy định tại khoản 1 Điều này, Bên được yêu cầu có thể chấp nhận dẫn độ đối với tất cả các hành vi đó.

    Điều 3

    Bắt buộc từ chối dẫn độ

    Việc dẫn độ sẽ bị từ chối nếu:

    a) Bên được yêu cầu coi tội phạm bị yêu cầu dẫn độ là tội phạm mang tính chất chính trị, tuy nhiên tội phạm về khủng bố không được coi là tội phạm chính trị.

    b) Bên được yêu cầu có lý do để cho rằng yêu cầu dẫn độ nhằm truy tố hoặc trừng trị người bị dẫn độ vì lý do chủng tộc, giới tính, tôn giáo, quốc tịch, hoặc quan điểm chính trị của người đó hoặc xâm hại đến vị trí của người này trong tố tụng hình sự vì một trong các lý do trên.

    c) Những tội phạm được yêu cầu dẫn độ chỉ là tội quân sự thuần túy theo pháp luật của Bên được yêu cầu.

    d) Vào thời điểm nhận được yêu cầu dẫn độ, người bị dẫn độ là công dân của Bên được yêu cầu hoặc đã được Bên được yêu cầu đồng ý cho tị nạn.

    e) Hành vi phạm tội hoặc bản án đã hết thời hiệu theo quy định của pháp luật của một trong các Bên.

    f) Tòa án của Bên được yêu cầu đã tuyên phán quyết cuối cùng hoặc đã kết thúc thủ tục tố tụng hình sự đối với người bị dẫn độ liên quan đến tội phạm yêu cầu dẫn độ hoặc người đó đã bị xét xử ở một nước thứ ba về tội phạm yêu cầu dẫn độ và đã được miễn hoặc đã chấp hành xong hình phạt.

    g) Yêu cầu dẫn độ của Bên yêu cầu là kết quả của một bản án bị tuyên vắng mặt và Bên yêu cầu không đưa ra bảo đảm về việc xét xử lại sau khi dẫn độ.

    h) Tội phạm yêu cầu dẫn độ là tội phạm có thể bị phạt tử hình theo pháp luật của Bên yêu cầu, trừ khi Bên yêu cầu bảo đảm mà Bên được yêu cầu cho là phù hợp về việc sẽ không áp dụng hình phạt tử hình hoặc nếu áp dụng thì hình phạt sẽ không được thực thi.

    Điều 4

    Có thể từ chối dẫn độ

    Dẫn độ có thể bị từ chối, nếu:

    a) Bên được yêu cầu có quyền tài phán đối với tội phạm được yêu cầu dẫn độ theo quy định của pháp luật nước đó và đang tiến hành hoặc có kế hoạch bắt đầu quá trình tố tụng đối với người bị yêu cầu dẫn độ về tội phạm này.

    b) Tội phạm được yêu cầu dẫn độ được thực hiện bên ngoài lãnh thổ của cả hai Bên, và Bên yêu cầu không có thẩm quyền đối với tội phạm thực hiện ngoài lãnh thổ của mình trong trường hợp tương tự.

    c) Bên được yêu cầu, mặc dù đã tính đến mức độ nghiêm trọng của tội phạm và lợi ích của Bên yêu cầu, xét thấy việc dẫn độ sẽ không phù hợp với nguyên tắc nhân đạo, trên cơ sở xem xét đến độ tuổi, sức khỏe hoặc hoàn cảnh cá nhân khác của người đó.

    d) Trường hợp tội phạm được yêu cầu dẫn độ có thể bị phạt tù chung thân, việc dẫn độ có thể bị từ chối nếu Bên yêu cầu không bảo đảm mà Bên được yêu cầu chấp nhận, về việc tình trạng mất tự do của người đó không kéo dài suốt cuộc đời.

    e) Yêu cầu dẫn độ đối với một người dưới 18 tuổi và việc dẫn độ có thể gây bất lợi cho việc thích nghi hoặc tái hòa nhập xã hội của người đó.

    Điều 5

    Nghĩa vụ tiến hành thủ tục tố tụng hình sự ở Bên được yêu cầu

    Nếu việc dẫn độ bị từ chối theo các quy định của Hiệp định này, Bên được yêu cầu cam kết sẽ đệ trình vụ việc lên cơ quan có thẩm quyền để bắt đầu thủ tục tố tụng hình sự theo quy định của pháp luật nước đó.

    Trong trường hợp này, Bên yêu cầu sẽ cung cấp cho Bên được yêu cầu các tài liệu và vật chứng liên quan đến vụ án qua kênh ngoại giao.

    Điều 6

    Cơ quan Trung ương

    1. Để thực hiện Hiệp định này, các cơ quan Trung ương gồm có:

    a) Cơ quan Trung ương của Cộng hòa xã hội chủ nghĩa Việt Nam là Bộ Công an;

    b) Cơ quan Trung ương của Vương quốc Tây Ban Nha là Bộ Tư pháp.

    2. Các Bên sẽ thông báo cho nhau về sự thay đổi liên quan đến Cơ quan Trung ương của mình qua kênh ngoại giao.

    Điều 7

    Yêu cầu dẫn độ và các tài liệu cần thiết

    1. Yêu cầu dẫn độ phải được lập thành văn bản và gồm có hoặc kèm theo:

    a) Tên, địa chỉ của cơ quan yêu cầu và cơ quan được yêu cầu dẫn độ;

    b) Họ, tên, giới tính, quốc tịch của người bị yêu cầu dẫn độ; ảnh, miêu tả tình trạng sức khỏe, dấu vân tay và nếu có thể, giấy tờ về quốc tịch và nơi lưu trú của người bị yêu cầu dẫn độ;

    c) Bản mô tả chi tiết vụ việc cùng với bản tóm tắt hành vi phạm tội, hậu quả của hành vi và địa điểm, thời gian xảy ra hành vi phạm tội;

    d) Văn bản pháp luật hiện hành về thẩm quyền tài phán, xác định tội danh và hình phạt có thể áp dụng; và

    e) Văn bản pháp luật hiện hành về thời hạn truy cứu hành vi phạm tội hoặc thi hành bản án.

    2. Ngoài những yêu cầu bắt buộc quy định tại khoản 1 Điều này:

    a) Yêu cầu dẫn độ để truy cứu trách nhiệm hình sự người bị dẫn độ phải kèm theo bản sao lệnh bắt của cơ quan có thẩm quyền của Bên yêu cầu, hoặc

    b) Yêu cầu dẫn độ để thi hành hình phạt đã tuyên đối với người bị dẫn độ phải kèm theo bản sao phán quyết của Tòa án và bản mô tả thời gian đã chấp hành hình phạt.

    3. Tất cả các tài liệu do Bên yêu cầu gửi theo quy định của Hiệp định này phải được chứng nhận và gửi kèm theo bản dịch ra tiếng của Bên được yêu cầu hoặc ra tiếng Anh.

    4. Tài liệu được chứng nhận theo quy định của Hiệp định này là tài liệu được ký hoặc xác nhận của thẩm phán hoặc quan chức có thẩm quyền của Bên yêu cầu và đóng dấu chính thức của cơ quan có thẩm quyền của Bên đó.

    Điều 8

    Thông tin bổ sung

    1. Nếu Bên được yêu cầu thấy rằng thông tin đã cung cấp kèm theo yêu cầu dẫn độ không đầy đủ để tiến hành việc dẫn độ theo Hiệp định này, thì có thể yêu cầu cung cấp các thông tin bổ sung trong thời hạn 30 ngày. Yêu cầu cung cấp này có thể được gia hạn thêm 15 ngày.

    2. Trường hợp người bị yêu cầu dẫn độ đang bị bắt giữ và các thông tin bổ sung đã cung cấp theo Hiệp định này không đầy đủ hoặc không nhận được trong khoảng thời gian đã ấn định, thì người bị bắt giữ có thể được trả tự do.

    3. Trong trường hợp người đó được trả tự do khỏi nơi giam giữ theo khoản 2 Điều này, Bên được yêu cầu sẽ thông báo cho Bên yêu cầu trong thời gian sớm nhất có thể.

    Điều 9

    Bắt khẩn cấp

    1. Trong trường hợp khẩn cấp, một Bên có thể yêu cầu Bên kia bắt khẩn cấp người bị yêu cầu dẫn độ, trước khi Bên này nhận được yêu cầu dẫn độ. Yêu cầu bắt khẩn cấp có thể được gửi bằng văn bản qua kênh ngoại giao hoặc qua Tổ chức Cảnh sát hình sự quốc tế (INTERPOL), hoặc qua bất kỳ kênh liên lạc nào được hai Bên đồng ý.

    2. Yêu cầu bắt khẩn cấp phải bao gồm các chi tiết được quy định tại khoản 1 Điều 7 Hiệp định này, một bản tuyên bố về việc có các tài liệu theo quy định tại khoản 2 Điều 7 và một bản tuyên bố rằng yêu cầu dẫn độ sẽ được chuyển đến ngay.

    3. Bên được yêu cầu phải thông báo ngay cho Bên yêu cầu về quá trình thực hiện yêu cầu.

    4. Việc bắt khẩn cấp sẽ chấm dứt nếu trong thời hạn 40 ngày từ khi thực hiện bắt giữ người bị yêu cầu dẫn độ, cơ quan có thẩm quyền của Bên được yêu cầu không nhận được yêu cầu dẫn độ chính thức. Thời hạn này có thể được gia hạn thêm 15 ngày theo yêu cầu chính đáng, hợp lệ của Bên yêu cầu.

    5. Việc thả người theo quy định tại khoản 4 Điều này sẽ không ảnh hưởng đến việc dẫn độ người bị yêu cầu dẫn độ nếu Bên được yêu cầu nhận được yêu cầu chính thức sau đó.

    Điều 10

    Quyết định liên quan đến yêu cầu dẫn độ

    1. Bên được yêu cầu sẽ ra quyết định liên quan đến yêu cầu dẫn độ theo các thủ tục pháp luật trong nước quy định và thông báo ngay cho Bên yêu cầu về quyết định đó.

    2. Trường hợp Bên được yêu cầu từ chối toàn bộ hoặc một phần yêu cầu, phải thông báo cho Bên yêu cầu về lý do từ chối.

    3. Từ chối dẫn độ với căn cứ hợp lý sẽ ngăn Bên yêu cầu đưa ra yêu cầu dẫn độ mới về cùng một người với cùng hành vi.

    Điều 11

    Chuyển giao người bị dẫn độ

    1. Nêu Bên được yêu cầu đồng ý dẫn độ, hai Bên sẽ thỏa thuận về địa điểm, thời gian và các điều kiện khác liên quan đến việc thực hiện yêu cầu dẫn độ. Trong khi đó, Bên được yêu cầu dẫn độ sẽ thông báo cho Bên yêu cầu về thời hạn mà người này đã bị bắt giữ trước khi tiến hành bàn giao người đó.

    2. Nếu Bên yêu cầu không nhận người trong thời hạn 15 ngày sau ngày thỏa thuận thực hiện dẫn độ, Bên được yêu cầu sẽ thả ngay người bị yêu cầu dẫn độ và có thể từ chối yêu cầu dẫn độ mới của Bên yêu cầu liên quan đến người đó về cùng một hành vi phạm tội trừ trường hợp quy định tại khoản 3 Điều này.

    3. Trường hợp một Bên không bàn giao hoặc không nhận người trong thời hạn thỏa thuận do những tình huống bất khả kháng thì phải thông báo ngay cho Bên kia. Các Bên sẽ thỏa thuận lại các điều kiện để tiến hành dẫn độ và áp dụng quy định tại khoản 2 Điều này.

    4 Trường hợp người đã chuyển giao trốn tránh việc truy cứu trách nhiệm hình sự hoặc thi hành hình phạt ở Bên yêu cầu và quay trở lại Bên được yêu cầu thì Bên yêu cầu dẫn độ có thể đưa ra một yêu cầu dẫn độ mới đối với người đó kèm theo các tài liệu quy định tại Điều 7 Hiệp định này.

    Điều 12

    Hoãn chuyển giao và chuyển giao tạm thời

    1. Khi người bị yêu cầu dẫn độ đang bị Bên được yêu cầu truy cứu trách nhiệm hình sự hoặc đang chấp hành hình phạt về một tội phạm khác với tội phạm nêu trong yêu cầu dẫn độ, thì Bên được yêu cầu sau khi đồng ý với yêu cầu dẫn độ, sẽ hoãn việc chuyển giao người đó cho đến khi kết thúc quá trình truy tố hoặc chấp hành toàn bộ hoặc một phần hình phạt đã tuyên. Bên được yêu cầu sẽ thông báo cho Bên yêu cầu về việc hoãn dẫn độ nói trên. Khi điều kiện hoãn dẫn độ kết thúc thì Bên được yêu cầu phải thông báo ngay cho Bên yêu cầu và tiếp tục tiến hành việc dẫn độ nếu không có thông báo khác của Bên yêu cầu.

    2. Nếu việc hoãn chuyển giao theo quy định tại khoản 1 Điều này có thể dẫn đến việc hết thời hiệu hoặc gây khó khăn cho việc điều tra tội phạm tại Bên yêu cầu, Bên được yêu cầu có thể, theo quy định của pháp luật nước mình, dẫn chuyển giao tạm thời người bị yêu cầu dẫn độ cho Bên yêu cầu, phù hợp với thời hạn và điều kiện mà hai Bên thỏa thuận. Bên yêu cầu sẽ chuyển trả lại nhanh chóng người bị yêu cầu dẫn độ cho Bên được yêu cầu ngay khi kết thúc các thủ tục liên quan.

    Điều 13

    Yêu cầu dẫn độ được đưa ra bởi nhiều quốc gia

    1. Nếu yêu cầu dẫn độ về cùng một người được đưa ra bởi một trong hai Bên và một hoặc nhiều Bên thứ ba, Bên được yêu cầu sẽ quyết định dẫn độ cho nước nào và thông báo cho Bên yêu cầu về quyết định đó.

    2. Khi quyết định nước nào sẽ được dẫn độ người này, Bên được yêu cầu sẽ tính đến tất cả yếu tố có liên quan đặc biệt là:

    a) Quốc tịch hoặc nơi thường trú của người bị yêu cầu dẫn độ;

    b) Thời gian và địa điểm thực hiện tội phạm;

    c) Mức độ nghiêm trọng của hành vi phạm tội;

    d) Quốc tịch của người bị hại;

    e) Khả năng dẫn độ tiếp đến nước yêu cầu khác;

    f) Ngày đưa ra yêu cầu dẫn độ.

    Điều 14

    Quy tắc đặc biệt

    Người bị dẫn độ sẽ không bị truy cứu trách nhiệm hình sự, bị kết án, giam giữ hoặc hạn chế bất kỳ tự do thân thể nào vì những hành vi hành động hoặc không hành động đã thực hiện trước khi chuyển giao người đó, trừ hành vi mà vì đó người này bị dẫn độ, trừ một trong các trường hợp sau:

    a) Bên được yêu cầu đã đồng ý trước. Trong trường hợp này, Bên được yêu cầu sẽ yêu cầu gửi các tài liệu và thông tin liên quan quy định tại Điều 7 Hiệp định này cùng với tờ khai của người bị dẫn độ về các tội phạm đó;

    b) Khi được trả tự do, người bị dẫn độ đã không rời lãnh thổ của Bên mà người đó bị yêu cầu dẫn độ trong thời hạn 45 ngày. Tuy nhiên, thời hạn này không bao gồm thời gian người đó không thể rời lãnh thổ Bên yêu cầu vì có tình huống phát sinh vượt quá khả năng kiểm soát của người đó, hoặc;

    c) Người đó đã rời khỏi lãnh thổ của Bên yêu cầu sau khi dẫn độ và tự nguyện quay trở lại lãnh thổ đó.

    Điều 15

    Chuyển giao tài sản

    1. Theo pháp luật của Bên được yêu cầu và trên cơ sở tôn trọng quyền lợi của bất kỳ Bên thứ ba nào, mọi vật được sử dụng để thực hiện tội phạm hoặc những tài sản do phạm tội mà có và các tài sản khác tìm thấy trên lãnh thổ của Bên được yêu cầu có thể là những chứng cứ có giá trị sẽ được chuyển giao theo đề nghị của Bên yêu cầu nếu việc dẫn độ được chấp thuận.

    2. Trường hợp chấp thuận dẫn độ, vật đề cập tại khoản 1 Điều này có thể được chuyển giao, kể cả khi việc dẫn độ không thực hiện được do người bị yêu cầu dẫn độ chết, mất tích hoặc bỏ trốn.

    3. Việc chuyển giao tài sản sẽ không ảnh hưởng đến bất kỳ quyền lợi hợp pháp nào của Bên được yêu cầu hoặc bất kỳ bên thứ ba nào đối với tài sản đó. Trường hợp có các quyền hợp pháp đó, Bên yêu cầu phải, theo đề nghị của Bên được yêu cầu, nhanh chóng hoàn trả miễn phí các tài sản đã được chuyển giao cho Bên được yêu cầu sau khi kết thúc thủ tục tố tụng hình sự.

    4. Bên được yêu cầu có thể, vì mục đích tiến hành các thủ tục tố tụng hình sự khác, hoãn việc chuyển giao vật nói trên đến khi kết thúc thủ tục hoặc tạm thời chuyển giao vật nói trên với điều kiện vật đó phải được Bên yêu cầu trả lại trong thời gian sớm nhất có thể sau khi kết thúc thủ tục tố tụng hình sự.

    Điều 16

    Quá cảnh

    1. Trường hợp một trong các Bên dẫn độ một người từ một nước thứ ba qua lãnh thổ của Bên kia, Bên đó sẽ yêu cầu được cho phép quá cảnh. Việc cho phép nói trên sẽ không cần thiết nếu sử dụng đường hàng không và không hạ cánh trên lãnh thổ của Bên đó trong lịch trình bay.

    2. Bên được yêu cầu sẽ cho phép quá cảnh theo đề nghị của Bên yêu cầu trong phạm vi không trái với pháp luật nước mình.

    Điều 17

    Thông báo kết quả

    Bên yêu cầu sẽ thông báo ngay cho Bên được yêu cầu những thông tin liên quan đến quá trình tố tụng hoặc thi hành hình phạt đối với người bị yêu cầu dẫn độ, hoặc những thông tin liên quan đến việc dẫn độ người đó cho Bên thứ ba.

    Điều 18

    Chi phí

    1. Mỗi Bên sẽ chịu mọi chi phí liên quan trong quá trình thực hiện yêu cầu dẫn độ phát sinh trên lãnh thổ nước mình, trừ khi các Bên có thỏa thuận khác.

    2. Chi phí giao thông và quá cảnh liên quan đến việc giao hoặc nhận người bị dẫn độ do Bên yêu cầu chi trả.

    Điều 19

    Mối quan hệ với các điều ước quốc tế khác

    Hiệp định này sẽ không ảnh hưởng đến bất kỳ quyền và nghĩa vụ nào của các Bên theo các điều ước hay thỏa thuận quốc tế khác.

    Điều 20

    Giải quyết tranh chấp

    Mọi tranh chấp phát sinh liên quan đến việc giải thích hoặc áp dụng Hiệp định này sẽ được giải quyết qua tham vấn ngoại giao.

    Điều 21

    Hiệu lực và chấm dứt hiệu lực của Hiệp định

    1. Hiệp định này sẽ được phê chuẩn theo pháp luật  hiện hành của mỗi bên. Hiệp định này sẽ có hiệu lực vào ngày thứ nhất tháng thứ hai kể từ khi trao đổi văn kiện phê chuẩn.

    2. Hiệp định này sẽ có hiệu lực vô thời hạn.

    3. Mỗi Bên có thể chấm dứt Hiệp định này bằng việc gửi thông báo bằng văn bản cho nhau vào bất kỳ thời điểm nào qua kênh ngoại giao. Trong trường hợp đó, Hiệp định sẽ hết hiệu lực sau sáu (06) tháng kể từ ngày thông báo.

    Để làm bằng, những người ký tên dưới đây, được ủy quyền đầy đủ, đã ký Hiệp định này.

    Làm tại Madrid, ngày 01 tháng 10 năm 2014 thành hai bản gốc bằng tiếng Việt, tiếng Tây Ban Nha và tiếng Anh, tất cả các văn bản đều có giá trị như nhau.

    TREATY ON EXTRADITION

    BETWEEN THE SOCIALIST REPUBLIC OF VIETNAM AND THE KINGDOM OF SPAIN

     

    The Socialist Republic of Viet Nam and the Kingdom of Spain, hereinafter referred to as “Parties”;

    Desiring to maintain and strengthen the ties joining their two countries;

    Desiring to establish more effective cooperation between their two States in the persecution of crimes and the enforcement of sentences; especially in the fight against organized crime and terrorism;

    Convinced of the interests of the both Parties in strenthening cooperation on criminal matters, especially extradition,

    Have agreed as follows:

    Article 1

    Obligation to extradite

    The Parties agree to extradite to each other, in accordance with the provisions of this Treaty and at the request of the Requesting Party, those persons found on their territory and who are wanted by the Requesting Party for prosecution or for the enforcement of a sentence or security measure handed down by its courts, for an extraditable offence.

    Article 2

    Extraditable Offences

    1. Extradition shall only be granted for those offences punishable under the laws of both Parties, and which meet one of the following conditions:

    a) If the extradition request is aimed at conducting criminal proceedings, that the offence carries a sentence under the legislation of both Parties of a prison term of longer than one year; or

    b) If the extradition request is aimed at enforcing a sentence or security measure involving deprivation of liberty, at the time of making the request, a period of a least six months of the penalty remains to be served on the part of the person whose extradition is requested.

    2. In determining whether an act constitutes an offence under the laws of both Parties in accordance with paragraph 1 of this Article, it shall not matter whether the laws of both Parties place the act within the same category of the offence or denominate the offence by the same terminology.

    3. If the extradition request refers to two or more actions, each one of which consititutes an offence under the legislation of both Parties, and at least one of them fulfils the condition of periods of penalties provided for in paragraph 1 of this Article, the Requested Party may grant the extradition for all of them.

    Article 3

    Mandatory refusal of extradition

    Extradition shall be denied if:

    a) The Requested Party considers that the offence requested for extradition is an offence bearing political character, however the offence of terrorism shall not be considered political offence.

    b) The Requested Party has reason to believe that the extradition request was presented with the aim of prosecuting or punishing the person sought on account of that person’s race, sex, religion, nationality or political opinions, or adversely affecting the position of the person involved in the criminal proceedings for one of these reasons.

    c) The offences for which extradition is requested are purely military offences under the law of the Requested Party.

    d) The person sought is a national of the Requested Party at the moment when the extradition request is received, or has been granted asylum by the Requested Party.

    e) The criminal action or sentence has lapsed by prescription under the law of either of the Parties.

    f) The courts of the Requested Party have already passed final judgment or concluded a criminal proceedings against the person sought with regard to the offence for which extradition is requested, or the person sought has been tried in a third State for the offence for which extradition is sought, and has been acquitted or fully served the corresponding sentence.

    g) The Extradition request is made as result of a sentence passed in absentia, and the Requesting Party offers no guarantee of the retrial after extradition.

    h) The offence for which extradition is punishable by death under the law of the Requesting Party, unless the Requesting Party provides an assurance, considered sufficient by the Requested Party, that the death penalty will not be imposed, or, if imposed, will not be carried out.

    Article 4

    Discretionary Refusal of Extradition

    Extradition may be denied if:

    a) The Requested Party has jurisdiction over the offence for which extradition is sought, in accordance with its own national law, and is carrying out or plans to initiate a criminal proceedings against the requested person for this offence.

    b) The offence for which extradition is sought was committed outside the territory of both Parties, and the Requesting Party lacks jurisdiction over offence committed outside of its territory under similar circumstances.

    c) The Requested Party, although taking into account the gravity of the offence and the interests of the Requesting Party, considers the extradition would be incompatible with humanitarian considerations, in view of the person’s age, health, or any other personal circumstance.

    d) If the offence for which extradition is sought can be subject to a life sentence the extradition may be denied if the Requesting Party does not offer assurance, considered sufficient by the Requested Party, that this privation of liberty shall not be indefectibly for life.

    e) If the extradition resquest is for a person under eighteen years of age, and said extradition may be detrimental to that person’s social adaptation or rehabilitation.

    Article 5

    Obligation to Initiate Criminal Proceedings in the Requested Party

    If extradition is denied under the provisions of this Treaty, the Requested Party undertakes to submit the case to its competent authorities for the purpose of initiating a criminal proceeding in accordane with its national law.

    In this case, the Requesting Party shall provide the Requested Party with the documents and evidence relating to the case through diplomatic channels.

    Article 6

    Central Authorities

    1. To implement this Treaty, the Central Authories are:

    a) The Central Authority of the Socialist Republic of Viet Nam is the Ministry of Public Security;

    b) The Central Authority of the Kingdom of Spain is the Ministry of Justice.

    2. The Parties shall inform the other of changes of their Central Authorities through diplomatic channels.

    Article 7

    Extradition Request and Required Documents

    1. Requests for extradition shall be presented in writing, and should include or be accompanied by:

    a) name and address of the requesting authority and the requested authority for extradition;

    b) full name, gender and nationality of the person requested for extradition; photograph, physical descripton, fingerprints and if possible, documentation of citizenship and place of residence of the person requested for extradition;

    c) a description of the case, with a summary of the criminal acts and their results stating the place and time of commission of the acts;

    d) the text of relevant legal provisions regarding the establishment of criminal jurisdiction, dertermination of the offence, and the sentence which could be imposed for the same; and

    e) the text of the relevant legal provisions describing the statute of limitations for the prosecution of the criminal act or for the enforcement of the sentence.

    2. In addition to the requirements of paragraph 1 of this Article:

    a) the extradition request aimed at the criminal prosecution of the person sought should also be accompanied by a copy of the warrant of arrest issued by the competent authority of the Requesting Party; or

    b) the extradition request aimed at carring out a sentence imposed on the person sought should also be accompanied by a copy of the court decision and a description of the period of the sentence already served.

    3. All documents submitted by the Requesting Party under the provisions of this Treaty shall be certified and sent together with the translation into the language of the Requested Party or English.

    4. Documents certified under the provisions of this Treaty are documents signed or identified by the judge or the competent officials of the Requesting Party and the official seal of the competent authorities of the Party.

    Article 8

    Additional Information

    1. If the Requested Party considers that the information provided in support of an extradition request is not sufficient to carry out extradition under this Treaty, that Party may request to be provided with additional information within a period of 30 days. This may be extended another 15 days.

    2. In case the requested person for extradition is arrested and the additional information provided under this Treaty is insufficient or not received during the period fixed, the person arrested may be released.

    3. In case the person was released from custody pursuant to paragraph 2 of this Article, the Requested Party shall inform the Requesting Party as soon as possible.

    Article 9

    Provisional Arrest

    1. In case of urgency, one Party may ask the other to provisionally arrest the person sought, pending receipt of the extradition request. The request for provisional arrest may be sent in writing through diplomatic channels, or the International Criminal Police Organization (INTERPOL), or any other channel agreed upon by both Parties.

    2. The request for provisional arrest shall contain the same details indicated in paragraph 1 of Article 7 of this Treaty, a declaration regarding the existence of the documents indicated in paragraph 2 of the same Article, and a declaration that the extradition request shall be sent without delay.

    3. The Requested Party shall promptly inform the Requesting Party regarding the processing of its request.

    4. The provisional arrest shall be terminated if, within a period of 40 days beginning from the arrest of the person sought, the competent authority of the Requested Party has not received the formal extradition request. This period may be extended for 15 days, at the duly justified request of the Requesting Party.

    5. The release of a person pursuant to paragraph 4 of this Article shall be without prejudice to the extradition of the person sought if the Requested Party subsequently receives the formal extradition request.

    Article 10

    Decision regarding the Extradition Request

    1. The Requested Party shall make a decision regarding the extradition request in accordance with the procedures stipulated in its national legislation, and shall promptly inform the Requesting Party of its decision.

    2. If the Requested Party refuses the request totally or partially, it shall inform the Requesting Party of its motives for refusal.

    3. Refusal of an extradition on reasonable grounds shall prevent the Requesting Party from presenting a new extradition request against the same person for the same actions.

    Article 11

    Surrender of Persons

    1. If the Requested Party grants the extradition, both Parties shall agree upon the place, time, and any other circumstances regarding execution of the extradition. Meanwhile the Requested Party shall inform the Requesting Party of the period of time during which the person has been under arrest prior to being surrendered.

    2. If the Requesting Party fails to collect the person within a perrod of 15 days after the agreed date for executing the extradition, the Requested Party shall immediately release the person and may reject a new extradition request from the Requesting Party referring to the same person and the same acts, unless paragraph 3 of this Article stipulates otherwise.

    3. If one of the Parties does not surrender or does not collect the person within the agreed period due to circumstances beyond their control, the other Party shall be notified promptly. The Parties shall once again agree upon the terms for executing the extradion, applying the stipulations in paragraph 2 of this Article.

    4. If the surrendered person has avoided the prosecution or service of the sentence in the Requesting Party and returned to the Requested Party, the Requesting Party may present a new request for extradition of that person. The request must be accompanied by the documents specified in Article 7 of this Treaty.

    Article 12

    Postponement of Surrender and Temporary surrender

    1. When the person sought is being proceeded against or is serving a sentence for an offence other than that for which extradition is requested, the Requested Party, after having agreed to grant the extradition, may postpone the surrender of that person until the completion of the proceedings or the service of the whole or part of the sentence imposed. The Requested Party shall inform the Requesting Party of this postponement. When conditions of postponement of the extradition end, the Requested Party must inform the Requesting Party promptly and proceed with the extradition if there is no other notice of the Requesting Party.

    2. If the postponement of surrender cited in pharagraph 1 of this Article could lead to exhausting the statute of limitations on the action, or make it difficult for the Requesting Party to investigate the offence, the Requested Party may, to the extent that its laws permit, temporarily surrender the person sought to the Requesting Party, in accordance with the terms and conditions agreed upon by both Parties. The Requesting Party shall promply return that person to the Requested Party upon conclusion of the relevant procedure.

    Article 13

    Extradition Requests Formulated by Various Countries

    1. If the extradition of the same person has been requested by one of the Parties and one or more third countries, the Requested Party shall decide, at its discretion, to which one of them it will surrender the person sought, and shall notify the Requesting Party of its decision.

    2. In determing to which country a person is to be extradited, the Requested Party shall have regard to all relevant circumstances and, in particular, to:

    a) Nationality or permanent residence of the person sought;

    b) Time and place of committing the crime;

    c) The seriousness of acts of the offence;

    d) The nationality of the victims;

    e) Possibility of subsequent extradition to the other requesting country;

    f) The date of the extradition request.

    Article 14

    Principle of Specialty

    A person who has been extradited shall not be proceeded against, sentenced or detained nor be subjected to any other restriction to personal liberty for any act or ommission commited prior to that person’s surrender, other than that for which the person was extradited, except in the following cases:

    a) the Requested Party has given its prior consent. To this effect, the Requested Party shall demand that the documents and information cited in Article 7 this Treaty be sent, along with a declaration by the extradited person regarding the offences in question;

    b) when set free, the extradited person has not left the territory of the Party which he is requested for extradition within a period of 45 days. However, this term does not include the time during which the person has not been able to leave the territory of the Requesting Party due to circumstances arising beyond his or her control; or

    c) the person has left the territory of the Requesting Party after extradition and voluntarily returned to that territory.

    Article 15

    Surrender of Property

    1. In accordance with the law of the Requested Party and on the basis of respect for the rights of any third party, any object used in the offence or the proceeds thereof, and any other property that may be found on its territory which could have evidential value shall be surrenderred al the request of the Requesting Party if the extradition is granted.

    2. When the extradition is granted, the objects mentioned in the previous paragraph may be surrendered, even if the extradition may be not be carried out due to the death, disappearance, or flight of the person sought.

    3. The surrender of such property shall not prejudice any legitimate right of the Requested Party or any third party to that property. Where the right exists, the Requesting Party shall, at the request of the Requested Party, promptly return the surrendered property, at no cost to the Requested Party, after the conclusion of the criminal procedure.

    4. The Requested Party may, for the purpose of carrying out another pending criminal procedure, postpone the surrender of the property cited above until the conclusion of the same, or temporarily surrender said property on the condition that they be returned by the Requesting Party, as soon as possible after the conclusion of the criminal procedure.

    Article 16

    Transit

    1. If one of the Parties is to extradite a person from a third country through the territory of the other Party, it shall request transit authonzation. Such authorization shall not be necessary where air transport is used, and no landing in the territory of said Party is scheduled.

    2. The Requested Party shall authorize the transit requested by the Requesting Party to the extent that it does not contravene the former’s legislation.

    Article 17

    Notification of the Outcome

    The Requesting Party shall promplty provide the Requested Party with information regarding the proceedings or the enforcement of the sentence against the extradited person, or information regarding the extradition of said person to a third country.

    Article 18

    Expenses

    1. Each Party shall bear the cost derived during the process of implementation of extradition requests arising on its territory, unless otherwise agreed by the Parties.

    2. Transport and transit expenses related to the surrender or collection of the extradited person shall be borne by the Requesting Party.

    Article 19

    Relationship with other Treaties

    This Treaty shall not affect the rights and obligations assumed by the Parties in accordance with any other Treaty.

    Article 20

    Resolution of Disputes

    Any dispute which may arise in the interpretation or implementation of the present Treaty shall be resolved through diplomantic consultation.

    Article 21

    Entry lnto Force and Termination

    1. This Treaty shall be ratified by the current legislation of each Party. This Treaty shall enter into force on the first day of the second month afer the exchange of instruments of ratification.

    2. This Treaty shall have an indefinite duration.

    3. Each of the Parties may terminate this Treaty in the written notification at any time, through diplomatic channels. This termination shall take effect six (06) months after the notification date.

    IN WITNESS WHEREOF, the undersigned, duly authorised, have signed this Treaty.

    Done at Madrid, this 01 day of October in the year 2014 in two original copies, in the Vietnamese, Spanish and English languages, all texts being equally authentic.
