Về việc điều ước quốc tế có hiệu lực

Thực hiện quy định tại Điều 56 của Luật Điều ước quốc tế năm 2016, Bộ Ngoại giao trân trọng thông báo:

Công hàm sửa đổi Hiệp định giữa Chính phủ nước Cộng hòa xã hội chủ nghĩa Việt Nam và Chính phủ nước Cộng hòa Liên bang Mi-an-ma về miễn thị thực cho ngưòi mang hộ chiếu phổ thông, ký tại Hà Nội ngày 01 tháng 11 năm 2019, có hiệu lực từ ngày 01 tháng 01 năm 2020.

Bộ Ngoại giao trân trọng gửi bản sao Công hàm theo quy định tại Điều 59 của Luật nêu trên./.

Bộ Ngoại giao nước Cộng hòa xã hội chủ nghĩa Việt Nam kính chào Bộ Ngoại giao nước Cộng hòa Liên bang Mi-an-ma và liên quan đến việc sửa đổi Hiệp định miễn thị thực cho người mang hộ chiếu phổ thông hai nước, hân hạnh trao đổi như sau:

Năm 2013, Việt Nam và Mi-an-ma đã ký Hiệp định giữa Chính phủ nước Cộng hòa xã hội chủ nghĩa Việt Nam và Chính phủ nước Cộng hòa Liên bang Mi-an-ma về miễn thị thực cho người mang hộ chiếu phổ thông (Hiệp định), có hiệu lực từ ngày 26/10/2013.

Với mong muốn tạo thuận lợi hơn nữa và thúc đẩy hợp tác song phương, giao lưu hữu nghị giữa công dân hai nước, Chính phủ nước Cộng hòa xã hội chủ nghĩa Việt Nam trân trọng đề xuất việc kéo dài thời hạn lưu trú miễn thị thực cho người mang hộ chiếu phổ thông hai nước từ 14 ngày lên thành 30 ngày, trừ trường hợp nhập cảnh với mục đích lao động hoặc các hoạt động thương mại khác bằng cách sửa đổi Điều 2 Hiệp định như sau:

"1. Công dân mỗi Bên ký kết được miễn thị thực nhập cảnh, xuất cảnh, quá cảnh quy định tại Điều 1 của Hiệp định này, được tạm trú trên lãnh thổ Bên ký kết kia trong thời gian không quá ba mươi (30) ngày kể từ ngày nhập cảnh, trừ trường hợp nhập cảnh với mục đích lao động hoặc các hoạt động thương mại khác. Trong trường hợp gặp trở ngại ngoài ý muốn, cơ quan có thẩm quyền Bên ký kết kia sẽ gia hạn tạm trú khi có yêu cầu bằng văn bản của cơ quan đại diện ngoại giao hoặc Cơ quan lãnh sự của nước mà người có yêu cầu là công dân.

2. Công dân một Bên ký kết muốn nhập cảnh vào lãnh thổ của Bên ký kết kia với mục đích tạm trú quá ba mươi (30) ngày hoặc với mục đích lao động hoặc các hoạt động thương mại khác phải có thị thực được cấp bởi cơ quan có thẩm quyền của Bên ký kết kia."

Trong trường hợp Chính phủ nước Cộng hòa Liên bang Mi-an-ma đồng ý, Công hàm trả lời của Bộ Ngoại giao nước Cộng hòa Liên bang Mi-an-ma đối với Công hàm này sẽ tạo thành thỏa thuận sửa đổi Điều 2 Hiệp định với nội dung nêu trên. Việc sửa đổi sẽ có hiệu lực kể từ ngày 01/01/2020.

Nhân dịp này, Bộ Ngoại giao nước Cộng hòa xã hội chủ nghĩa Việt Nam gửi đến Bộ Ngoại giao nước Cộng hòa Liên bang Mi-an-ma lời chào trân trọng.

The Ministry of Foreign Affairs of the Socialist Republic of Viet Nam presents its compliments to the Ministry of Foreign Affairs of the Republic of the Union of Myanmar and regarding the amendment of the Agreement between the Government of the Socialist Republic of Viet Nam and the Government of the Republic of the Union of Myanmar on Visa Exemption for Holders of Ordinary Passports, has the honor to address the following issue:

In 2013, the Government of the Socialist Republic of Viet Nam and the Government of the Republic of the Union of Myanmar had signed the Agreement on Visa Exemption for Holders of Ordinary Passports (hereinafter referred to as “the Agreement”), which came into effect from October 26^th, 2013.

With desire to facilitate and promote bilateral cooperation and friendly exchanges between citizens of Viet Nam and Myanmar, the Government of the Socialist Republic of Viet Nam kindly proposes the extension of visa- exempted stay for holders of ordinary passports of the two countries from 14 days to 30 days, provided that such stay shall not engage in employment or other commercial activities, by amending Article 2 of the Agreement as follows:

“1. Citizens of either Contracting Party exempted from entry and transit visa requirements under Article 1 of this Agreement shall be entitled to stay in the territory of the other Contracting Party for no more than thirty (30) days from the date of entry, provided that such stay shall not engage in employment or other commercial activities. In case of casual obstacles, an extension of stay may be requested in written form from the competent authorities of the latter Contracting Party by the diplomatic or consular post of the former Contracting Party.

2. Citizens of either Contracting Party intending to enter the territory of the other Party for a stay exceeding thirty (30) days or engaging in employment or other commercial activities will require visas issued by the competent offices of that Contracting Party.”

In case the Government of the Republic of the Union of Myanmar agrees with Viet Nam’s amendment proposal, the Myanmar’s reply note and this note shall constitute an agreement between the two Governments amending Article 2 of the Agreement with the abovementioned content. The amendment shall come into effect from January 1^st, 2020.

The Ministry of Foreign Affairs of the Socialist Republic of Viet Nam avails itself of this opportunity to renew the Ministry of Foreign Affairs of the Republic of the Union of Myanmar the assurances of its highest consideration.

The Ministry of Foreign Affairs of the Republic of the Union of Myanmar presents its compliments to the Ministry of Foreign Affairs of the Socialist Republic of Vietnam and has the honour to refer to the latter’s note No. 723/BNG-LS dated 10^th October 2019, regarding the Agreement between the Government of the Republic of the Union of Myanmar and the Government of the Socialist Republic of Vietnam on Mutual Visa Exemption for Holders of Ordinary Passports signed on 26 September 2013.

With desire to further facilitate and promote bilateral cooperation and friendly exchanges between the peoples of the two countries, the Government of the Republic of the Union of Myanmar is agreeable to the following amendment of the said Agreement:

“1. Citizens of either Contracting Party exempted from entry and transit visa requirements under Article 1 of this Agreement shall be entitled to stay In the territory of the other Contracting Party for no more than thirty (30) days from the date of entry, provided that such stay shall not engage in employment or other commercial activities. In case of casual obstacles, an extension of stay may be requested in written form from the competent authorities of the later Contracting Party by the diplomatic or consular post of the former Contracting Party.

2. Citizens of either Contracting Party intending to enter the territory of the other Party for a stay exceeding thirty (30) days or engaging in employment or other commercial activities will require visas issued by the competent offices of that Contracting Party.”

In this regard, the Ministry of Foreign Affairs of the Republic of the Union of Myanmar has the further honour to agree that the above amendment shall come into effect starting from January 1^st 2020.
